I had organized a flight from Qinhaungdao to Shanghai on the morning of Wednesday the 18th of July.
1. At the time the weather was apparently bad so the plane was delayed for 2 hours, which was fine.
2. Later the flight was further delayed for another 4 hours.
3. This delaying process continued for a whole day until 11pm at night, when we were taken to a hotel and given a room for a couple of hours.
4. After sleeping for a few hours we were up at 6am to be on a bus by 6:30am, when were inFORMed that we would definitely be catching the plane early in the morning - possibly 8:30am.
5. When we got to the airport we were inFORMed that the plane would be flying later at the same time as the previous day - 10:30am.
6. Then finally we were inFORMed that we would not be going at 10:30am but at 1:10pm in the afternoon.
7. I asked if the people that were booked on Thursday"s flight would be flying. They said “Yes”, but those booked on Wednesday"s flight will have to wait until 2pm.
8. To me, this is completely illogical and unreasonable. They should have organized all the people who had been delayed for 24 hours to be on the first flight and delay those booked on July 19’s flight if needed.
9. This is when I realized that Shanghai Airlines itself should be made aware of the situation, so that accountability for this could be levelled squarely at the company.
10.I had my assistant phone Shanghai Airlines and was inFORMed to speak with Ms. Wang. I phoned consistently but no reply.
11.Later I got in touch with Eva Fan from Shanghai Airlines. I made her aware of the situation and explained from a commercial point of view (legally) and from a fairness point of view that the fact Shanghai Airlines was delaying passengers booked on July 18’s flight by more than 27 hours and departed Qinhuangdao several hours later than those booked on July 19’s Qinhuangdao-Shanghai flight was wrongdoing. I also explained to her that she was now accountable for Shanghai Airlines and it was within her power to fix the issue. However, she did nothing – maybe that’s the way Shanghai Airlines does things.
12.At this point I went through the list of legal issues to see how many rules and ethics had been broken. Misrepresentation, commercial disadvantage, unfair discrimination – the list was long and proved that Shanghai Airlines had a legal case to answer.
13.We waited till 1pm and were inFORMed that the plane would arrive at 1:40pm. We all laughed – Shanghai Airlines’ credibility was shattered.
14.Finally the plane arrived at 2:30pm and we left Qinhuangdao at 3.10pm.
If you follow these points you will see that Shanghai Airlines’ legal position becomes very poor. Unfair, discriminatory and causing unfair commercial disadvantages to the passenger who had been waiting for more than a day. I have sent a copy of this letter to Shanghai Airlines and await their official reply. If I receive no reply legal proceedings may be launched in the future.
